Terms of Service

1. Agreement
These Terms of Service ("Terms") are an agreement between you and Single Desk Studio ("we", "us", or "our") governing your access to and use of Mindrop. By creating an account, accessing Mindrop, or using the service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Mindrop.
2. Eligibility and accounts
You must be at least 13 years old and legally able to enter into these Terms. A higher minimum age may apply where you live. You must provide accurate account information, protect your credentials, and promptly notify us of suspected unauthorised access. You are responsible for activity conducted through your account.
3. Mindrop and AI-generated content
Mindrop is a capture and organisation tool. Its Talk feature uses Google Gemini to analyse live audio and produce suggested items and related metadata. AI-generated content can be inaccurate, incomplete, inappropriate, or misleading. You must review suggestions before approving or relying on them.
Mindrop does not provide medical, legal, financial, emergency, or other professional advice. Do not rely on Mindrop as the sole repository for critical information or as a substitute for qualified advice or emergency services.
4. Voice capture and other people
You must only record audio that you are legally permitted to record. If another person may be captured, you are responsible for notifying them and obtaining any consent required by applicable law. You must not use Mindrop to monitor, intercept, or record others unlawfully.
5. Your content
You retain ownership of content you submit to Mindrop. You grant us a worldwide, non-exclusive, royalty-free licence to host, copy, transmit, process, and display that content only as reasonably necessary to operate, secure, support, and improve Mindrop and to comply with law.
You represent that you have the rights and permissions needed to submit your content. You are responsible for your content and for maintaining any independent backup you require.
6. Acceptable use
You must not use Mindrop to:
- break any law or infringe another person's privacy, intellectual property, or other rights;
- upload malicious code or interfere with the service, its security, or other users;
- attempt to access accounts, systems, or data without permission;
- abuse, probe, reverse engineer, or circumvent service limits except where the law permits;
- generate or distribute unlawful, harmful, deceptive, or abusive content; or
- resell or commercially exploit Mindrop without our written permission.
7. Subscriptions and billing
Some features require a paid subscription purchased through Google Play, Apple's App Store, or another displayed billing provider. The purchase screen will show the price, billing period, included benefits, and any trial terms before you subscribe.
Subscriptions renew automatically unless cancelled before the end of the current billing period. You can manage or cancel a subscription through the store or provider where you purchased it. Cancellation normally takes effect at the end of the paid period. Refunds are handled under the applicable store rules and any rights you have under consumer law.
We may change subscription prices or benefits with the notice and consent required by the applicable store and law. Restoring purchases requires use of the same eligible store account.
8. Availability and changes
We aim to keep Mindrop available but do not promise uninterrupted or error-free operation. Features may depend on internet access and third-party services. We may modify, suspend, or discontinue features, introduce reasonable limits, or perform maintenance. Where a change materially affects a paid service, we will provide notice where reasonably practicable.
9. Third-party services
Mindrop relies on third-party services, including Google Gemini, Supabase, RevenueCat, and app-store providers. Their services and terms may apply separately. We are not responsible for third-party services beyond what applicable law requires.
10. Suspension and termination
You may stop using Mindrop at any time. You may request account deletion by emailing singledeskstudio@gmail.com. Deleting the app alone does not necessarily cancel a subscription or delete cloud account data.
We may restrict, suspend, or terminate access if you materially breach these Terms, create security or legal risk, fail to pay applicable fees, or misuse the service. Where appropriate, we will give notice and a reasonable opportunity to address the issue.
11. Consumer rights and disclaimers
Nothing in these Terms excludes, restricts, or modifies a guarantee, right, or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.
To the maximum extent permitted by law, Mindrop is provided on an "as is" and "as available" basis. We do not warrant that AI output will be accurate or that the service will always be secure, available, or free from errors or data loss.
12. Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive loss, or for lost profits, opportunities, goodwill, or data arising from your use of Mindrop. Where liability cannot be excluded, our liability is limited only to the extent permitted by applicable law. This section does not limit liability that cannot legally be limited.
13. Changes to these Terms
We may update these Terms as Mindrop or applicable requirements change. We will update the date above and provide additional notice of material changes where required. Continuing to use Mindrop after revised Terms take effect constitutes acceptance where permitted by law.
14. Governing law
These Terms are governed by the laws of New South Wales, Australia, without excluding any mandatory rights you have under the laws of your place of residence. The courts of New South Wales have non-exclusive jurisdiction.
